Terms & Conditions:
By purchasing or using the services or products of Steve McLaren Photography you agree to the below Terms & Conditions. Please ensure you have read and understand the below Terms & Conditions. If you are unsure of anything, please contact us and ask before purchasing or using the services or products.
Copyright - All photographs remain the copyright of Steve McLaren Photography. This means it is prohibited for anyone else to copy, publish, reproduce or store images electronically unless permission from us has been granted. If copyright is granted, a charge will be made. The client (or anyone else) may not alter, add to, manipulate (by computer), or reproduce as part of another image, any photo.
Unforseen circumstances - Due performance of the contract is subject to alteration or cancellation by us owing to any cause beyond their control (e.g. Acts of God, legislative changes, fire, floods, computer failure etc.) In the unlikely event of total photographic failure or cancellation of this contract the limit of liability is limited to a full refund of all monies paid.
Artistic licence - we shall be granted artistic licence in relation to the photographed poses, the location used and digital retouching. Our judgment regarding the locations, poses and number of photographs taken, shall be deemed to be correct.
Reprints - All reprint orders will be treated as an extension of this contract, and no responsibility for error will be accepted unless orders are given in writing.
Payment - is by cheque or Paypal invoice. These bookings can be agreed on a 10% deposit of the total cost of your chosen package (non refundable), with the final balance payable 8 weeks before your Wedding, Training or Event.
Prices - all prices are those current at the time of supply and are subject to change without prior notice.
Storage of photographs - all original digital images will be retained for one year.
Display - We reserve the right to display any photograph created, to be used for display purposes in a portfolio, or used in advertising directly associated with Steve McLaren Photography.
The Law - Terms and Conditions are governed and construed in accordance with the Laws of England.
Liability - Any Photographer directly employed by us shall not be liable for indirect loss, or third party claims if there is a delay in completing work, or any loss to our customers arising from transit delay. If work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect.
Refunds:
- The 10% deposit is non refundable, nor any monies spent purchasing albums etc., or any specialised equipment for a wedding.
- we and our agents will not refund, nor accept the return of, or refusal to pay charges for, any technically acceptable photograph supplied in print or electronic format. No exception can be made, as we cannot be held responsible for individual tastes or exceptions.
- Photography vouchers are non-refundable (no refunds will be given if they are not used.)
Data Protection - In compliance with the Data Protection Act 1998, personal data supplied to us and to any person acting on its behalf, may be stored for future use. We will take all necessary steps to ensure the information is held and used in accordance with the above Act. However, should you not wish the data to be stored and/or removed, please contact us.
Confidentiality - we have a strict client confidentiality clause and no client details will be discussed with third parties. We reserves the right not to discuss client issues with a third party even if the client has given written permission to do so.
Withdrawal of Services - we reserves the right to withdraw from any wedding/event/training, whether the wedding/event/training, arrangements have started or not, and whether or not monies have been paid, (if monies have been paid, a full refund will be given, less any interest gained on such monies) if the client starts to make additional demands to those initially agreed, or if we believes that clients are using our services to obtain monies from third parties by deceit or fraudulent means, or any actions that may or would, in our opinion be likely to bring us into disrepute.
Photography vouchers - are only valid for the selected package named on a voucher. Photography vouchers are non-refundable. Photography vouchers are non-redeemable for cash. Photography vouchers can only be used once and must be surrendered on the day of the course. Photography vouchers are only valid for the period specified on a voucher. Photography vouchers carry a unique identifier to eliminate fraud and each voucher corresponds with records held by us. No discussion will be entered into should the reference number on a voucher not match the records held by us. N.B. Photography vouchers are sent to the buyer by e-mail. If you require a voucher to be sent by post, additional cost will be incurred.
Photo Frame - We will make every effort to buy branded named Photo Frames from well known High Street shops/Companies. Customers are then fully responsible for the return or replacement of faulty goods to the shop/company where the goods were purchased from. We will not accept any responsibility for these good(s) once the customer(s) receive the Photo Frame and receipt by hand from us.
